On November 24, 2010, Childress Loucks & Plunkett obtained a $4.4 million jury verdict in the U.S. District Court for the Southern District of Florida for another insured condominium association, this time against QBE Insurance Corporation. The lawsuit arose out of QBE’s failure to pay for loss and damage sustained during Hurricane Wilma, which is in violation of the insurance policy. QBE denied the Royal Bahamian’s claim after estimating the damages to be less than the policy’s deductible. With Childress Loucks & Plunkett’s assistance, Royal Bahamian sought to enforce its rights under the contract and was met with accusations of fraud for its trouble. Following a seven-day jury trial, Childress Loucks & Plunkett delivered to the insured the multi-million dollar verdict, which was over 40 times greater than QBE’s estimation of the loss years earlier. On June 20, 2011, Royal Bahamian was awarded $1.5 million in attorney fees, as well as more than $40,000 in costs.
